Troy Brooks

Mr. Brooks represents healthcare providers throughout the country by providing advice on regulatory compliance, licensure defense, mergers and acquisitions, Anti-Kickback Statute compliance, Stark Law compliance, and general legal advice.

As a former Assistant General Counsel for the Texas Department of Human Services (a legacy agency of the Texas Health and Human Services Commission), Mr. Brooks advised the Long-Term Care – Regulatory Division in regulating all non-acute long-term care in Texas.

Mr. Brooks has represented a wide range of providers before the Office of Medicare Hearings and Appeals, the Texas Health and Human Services Commission, the Provider Reimbursement Review Board, and the Texas State Office of Administrative Hearing. He has also represented health care providers in civil litigation in both state and federal courts.

Mr. Brooks has also handled government investigations with the Unites States Department of Justice, the Louisiana Office of Attorney General, the Texas Office of the Attorney General, the Texas Health and Human Services Commission – Office of Inspector General, and the Unites State Department of Health and Human Services’ Office of Inspector General. These include claims audits, overpayments, and fraud and abuse investigations.

Mr. Brooks has negotiated payment disputes with the above referenced entities in addition to Medicare Managed Care Organizations (MCOs), HMOs and private insurance.

In the area of mergers and acquisitions, Mr. Brooks as advised providers on business development strategies, choice of business entity, changes of ownership (CHOWs), changes of information (CHOIs), and common pitfalls to avoid in those areas.

Mr. Brooks has a Bachelor of Arts in History from the University of West Florida, Pensacola, Florida and a Juris Doctor from the Paul M. Hebert Law Center of Louisiana State University, Baton Rouge, Louisiana. He began his legal career in 1998 as Judicial Clerk to the Honorable B. Dexter Ryland, Chief Judge of the 9th Judicial District, Alexandria, Louisiana.

Mr. Brooks is admitted to practice in all Texas and Louisiana state courts. Mr. Brooks is admitted to practice before all Federal District Courts in Texas. Mr. Brooks is a member of the Texas Bar Association and the Louisiana State Bar Association. He is also a member of the Pediatric, Community Care, and Education Committees for the Texas Association for Home Care and Hospice. He is the former President of Avenue 360 Health & Wellness, Houston, Texas (a Federally Qualified Healthcare Center (FQHC)) and Chair of the Board for Bering-Omega Community Services, Houston, Texas.

Mr. Brooks is a frequent speaker on healthcare regulatory compliance.
